TERMS & CONDITIONS FOR JOB APPLICATION AND EXPERT NETWORK REGISTRATION

Welcome to the John&Partners Employment & Expert Sourcing System (“ESS”), Expert Network, Talent Marketplace, and related services (“Platform”).
By submitting an application, resume, profile, certification, portfolio, or any information through this Platform, you (“Applicant”, “Candidate”, “Expert”, or “User”) agree to the following Terms & Conditions.
1. PURPOSE OF THE PLATFORM
The Platform is designed to:
- Evaluate candidates for employment opportunities;
- Build and maintain a professional talent database;
- Develop a global network of experts, consultants, trainers, coaches, advisors, executives, and subject matter experts;
- Match professionals with employment, consulting, coaching, advisory, board, speaking, project-based, and other business opportunities;
- Facilitate professional networking, learning, and development initiatives.
Submission of an application does not guarantee employment, engagement, project assignment, membership approval, or future opportunities.
2. ELIGIBILITY
By applying, you represent and warrant that:
- You are at least 18 years of age;
- The information provided is accurate, complete, and truthful;
- You have the legal right to share all submitted information and documents;
- You are not violating any confidentiality, employment, non-compete, or contractual obligations by submitting your information.

4. TALENT DATABASE & EXPERT NETWORK CONSENT
By applying, you acknowledge and agree that your profile may be included in:
- John&Partners Talent Database;
- John&Partners Expert Network;
- Executive Network;
- Consultant Network;
- Trainer Network;
- Coach Network;
- Advisor Network;
- Future talent matching and workforce development programs.
Your information may be retained and considered for future opportunities even if you are not selected for the current position or project.
5. AI-ASSISTED SCREENING AND MATCHING
You acknowledge and consent that:
- Artificial Intelligence (AI) tools may be used to evaluate, categorize, rank, score, analyze, summarize, and match candidate profiles;
- AI-generated recommendations may be used to support human decision-making;
- Final decisions remain at the discretion of John&Partners and its authorized representatives.
No automated decision-making process alone shall guarantee or deny opportunities.
6. DATA SHARING
Your information may be shared with:
- John&Partners affiliates;
- Authorized clients;
- Hiring organizations;
- Business partners;
- Project sponsors;
- Professional service providers;
- Technology providers supporting recruitment, assessment, and talent management processes.
Such sharing shall be limited to legitimate business purposes related to talent evaluation, recruitment, project staffing, advisory services, training services, and professional opportunities.
7. CONFIDENTIALITY OF SUBMITTED INFORMATION
John&Partners will make commercially reasonable efforts to protect submitted information.
However, no electronic system can guarantee absolute security.
Applicants acknowledge and accept the inherent risks associated with online information transmission and storage.
8. NO GUARANTEE OF EMPLOYMENT OR ENGAGEMENT
Submission of an application does not create:
- An employment relationship;
- A consulting agreement;
- An independent contractor relationship;
- A partnership;
- A joint venture;
- A fiduciary relationship.
John&Partners reserves the right to:
- Reject applications;
- Remove profiles;
- Suspend accounts;
- Close opportunities;
- Modify selection criteria;
- Cancel recruitment processes at any time without prior notice.
9. PROFESSIONAL CONDUCT
Applicants agree to:
- Conduct themselves professionally;
- Respect confidentiality requirements;
- Refrain from submitting unlawful, offensive, discriminatory, or misleading content;
- Avoid misrepresenting credentials, certifications, experience, or achievements.
Violation of this section may result in permanent removal from the Platform.
10. INTELLECTUAL PROPERTY
All Platform content, branding, methodologies, frameworks, assessments, processes, software, documents, and materials are owned by John&Partners or its licensors.
Applicants may not reproduce, distribute, modify, or commercialize Platform materials without prior written authorization.
11. INTERNATIONAL APPLICANTS
The Platform may be accessed globally.
Applicants acknowledge that information submitted may be processed, transferred, and stored in jurisdictions different from their country of residence, including but not limited to the United States and Vietnam.
12. DATA RETENTION
Unless otherwise required by law, John&Partners may retain applicant information for:
- Current opportunities;
- Future opportunities;
- Talent management activities;
- Network development;
- Compliance purposes;
- Business recordkeeping.
Applicants may request profile updates or removal subject to applicable legal and contractual obligations.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, John&Partners shall not be liable for:
- Loss of opportunities;
- Lost income;
- Business interruption;
- Indirect damages;
- Consequential damages;
- Data transmission failures;
- Technology interruptions.
Total liability, if any, shall not exceed the amount paid by the applicant to access the Platform, if any.
14. PRIVACY RIGHTS
Applicants may request:
- Access to personal information;
- Correction of inaccurate information;
- Deletion of eligible information;
- Withdrawal from future communications.

15. GOVERNING LAW
For applicants located in the United States, these Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
For international applicants, John&Partners reserves the right to determine the appropriate governing jurisdiction based on the applicable engagement, project, or opportunity.
16. MODIFICATIONS
John&Partners may update these Terms & Conditions at any time.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.

By clicking “Apply,” “Submit,” “Join Network,” or any similar button, you acknowledge that:
- You have read and understood these Terms & Conditions;
- You consent to the collection and processing of your information;

- You authorize the use of AI-assisted evaluation and matching technologies;
- You agree to these Terms & Conditions in their entirety.
